Terms of Service

1. Acceptance of Terms
By accessing or using FlareCanary ("the Service"), operated by FlareCanary ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not access or use the Service. We reserve the right to update these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email at least 14 days before they take effect.
2. Description of Service
FlareCanary is an API schema monitoring service that detects changes in third-party API responses and notifies you of drift. The Service polls API endpoints you configure and compares response schemas over time. FlareCanary is a monitoring tool and is not a substitute for your own API integration testing, quality assurance, or incident response processes.
3. User Accounts
- You must provide a valid email address to create an account.
- You are responsible for maintaining the confidentiality and security of your account credentials. You are liable for all activity that occurs under your account.
- You must be at least 16 years old to use the Service.
- You may not create multiple accounts to circumvent tier limitations or for any other abusive purpose.
- You may not use the Service for illegal purposes or to monitor APIs in violation of their terms of service.
4. Service Tiers, Billing & Refunds
FlareCanary offers Free, Starter, and Pro tiers with different endpoint limits, polling intervals, and feature access. We reserve the right to modify tier limits, pricing, or features with 30 days' notice to affected users.
Paid subscriptions are billed in advance on a recurring basis. All fees are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused portions of a billing period.
We may offer promotional pricing or free trials. We reserve the right to modify or discontinue promotional offers at any time without notice.
5. Acceptable Use
You agree not to:
- Use the Service to overload, abuse, or interfere with third-party API endpoints
- Attempt to gain unauthorized access to other users' data or any part of the Service's infrastructure
- Reverse-engineer, decompile, or disassemble any portion of the Service
- Resell, sublicense, or redistribute the Service without our prior written authorization
- Use the Service in any way that violates applicable laws or regulations
- Transmit malicious code, perform security attacks, or attempt to exploit vulnerabilities in the Service
- Use automated means (bots, scrapers) to access the Service except through our documented APIs
We reserve the right to suspend or terminate accounts that violate these terms, at our sole discretion, with or without prior notice.
6. Intellectual Property
The Service, including its software, design, documentation, and branding, is owned by FlareCanary and protected by applicable intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to process your data solely to provide the Service to you.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee the accuracy, completeness, or timeliness of schema drift detection. The Service monitors third-party APIs that are outside our control, and we make no representations about their availability or behavior.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FLARECANARY, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).
Without limiting the foregoing, we are not liable for any damages arising from: missed or delayed drift detections; false positives or false negatives in schema comparison; service outages or downtime; changes to third-party APIs that affect Service functionality; or your reliance on the Service as your sole monitoring solution.
9. Indemnification
You agree to indemnify, defend, and hold harmless FlareCanary and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including any API provider's terms of service; or (d) any data you submit to the Service.
10. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, effective immediately. Reasons for termination may include, but are not limited to, violation of these Terms, abusive behavior, extended periods of inactivity, or if we discontinue the Service.
You may delete your account at any time through your account settings or by contacting us. Upon termination, your right to use the Service immediately ceases. We will delete your account data within 30 days of termination, except as required by law or legitimate business purposes (such as fraud prevention or resolving disputes).
Sections 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 9 (Indemnification), and 12 (Governing Law) survive termination of these Terms.
11. Service Availability
We do not guarantee any specific level of uptime or availability. We may modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in North Carolina, and you consent to the personal jurisdiction of such courts.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FlareCanary regarding the Service. These Terms supersede any prior agreements or understandings, whether written or oral.
